These Terms and Conditions (“Terms”) govern your use of www.guptagraphics.com and the design, printing, gifting, signage and fabrication services provided by Gupta Graphics (“Gupta Graphics”, “we”, “us”). By using the Website or placing an order, you agree to these Terms. This document is an electronic record under the Information Technology Act, 2000 and does not require a physical or digital signature.

1. Use of the Website

You may use the Website only for lawful purposes. You must not attempt to gain unauthorised access to the Website or its admin area, upload malicious code, send spam through our forms, copy content for commercial use, or use the Website in any way that breaches the IT Act or any other law.

2. Information on the Website

Product descriptions, images and catalogues are for general information and illustration. Actual materials, colours, sizes and finishes may vary. Information on the Website is not an offer; a binding order is formed only when we confirm your order in writing (including by email or WhatsApp) and any agreed advance is received.

3. Quotations and orders

• Quotations are valid for the period stated on them, or 15 days if no period is stated, and depend on the quantity, specifications and artwork shared.
• Prices are exclusive of GST and other applicable taxes unless stated otherwise.
• Any change in quantity, size, material, design or delivery requirements after confirmation may change the price and delivery date.
• Payment terms (advance, part-payment or on delivery) are as agreed in the quotation or order confirmation.

4. Artwork, proofs and approval

• You are responsible for checking every proof carefully – spelling, numbers, names, addresses, phone numbers, colours and layout.
• Production starts only after your approval. We are not responsible for errors in a proof that you have approved.
• Colours on screen (and in digital proofs) can look different from the printed result because screens and printing inks reproduce colour differently. Slight variation in colour, cutting and finishing between proofs and printed items, and between print runs, is normal in the printing industry and is not a defect.
• Files supplied in low resolution may print blurred; we will advise you where we notice this, but final responsibility for supplied files remains with you.

5. Your content and intellectual property

You confirm that you own or have permission to use all logos, trademarks, images, text and other content you send us, and that printing it does not infringe anyone’s rights or break any law. You agree to indemnify us against claims arising from content you supply. We may refuse any job that we consider unlawful, obscene, defamatory, hateful, infringing, or that promotes violence.

Designs created by us become yours for the agreed use once the order is paid in full. Until then, and for designs not ordered, they remain our property. The Website’s design, text and graphics belong to Gupta Graphics; client logos shown on the Website belong to their respective owners and are displayed only to show whom we have worked with.

6. Delivery and installation

• Delivery and completion dates are estimates made in good faith; we are not liable for delays caused by late approvals, changes, payment delays, material shortages or events beyond our control.
• Please inspect goods at delivery and report shortages or visible damage immediately.
• For hoardings, signage, stalls and other installations, obtaining permissions from building owners, societies, exhibition organisers or local authorities is the client’s responsibility unless agreed otherwise in writing. You must provide safe access to the site.

7. Cancellations and refunds

Cancellations, returns and refunds are governed by our Refund & Cancellation Policy.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses such as loss of business, profit or opportunity, including losses from delays or from errors in approved proofs.

9. Force majeure

We are not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, government restrictions, strikes, power or internet failures, and transport disruptions.

10. Governing law and disputes

These Terms are governed by the laws of India. We will first try to resolve any dispute through discussion. Subject to that, the courts at Gurugram, Haryana will have exclusive jurisdiction.

11. Changes

We may update these Terms at any time. The version on the Website at the time of your order applies to that order.
